Job Summary:

Reporting to the Manager, Legal Franchising & Real Estate, this Law Clerk’s primary responsibility will be providing legal support for franchising and real estate matters for all of its brands in Canada, including TIM HORTONS ® , BURGER KING ® and POPEYES ® . The successful candidate will be a key member of RBI’s Legal Centre of Excellence, and will work under the guidance and direction of the company’s Franchise and Real Estate lawyers in Oakville, Ontario. This position requires providing support to the legal and business teams in a fast-paced environment while maintaining a high level of professionalism.

Essential Responsibilities:

Essential Responsibilities

  • Provide legal support for day to day real estate matters including lease interpretation and application, drafting and reviewing lease amending agreements, non-disturbance agreements, real estate dispositions, property management issues, common area maintenance issues, lease/sublease issues, signage, environmental issues, planning issues, title issues, expropriations, construction issues, default notices received from landlords, and collection of tenant allowances on new restaurants. Responsibilities will include:

  • Reviewing, interpreting and drafting legal real estate documents

  • Acting as a liaison to our landlords and other departments within the corporation including: asset management, development, construction, accounting and operations

  • Provide legal support for day to day franchise matters including defaults, terminations, franchise-to-franchise sales, assignment documents, changes of ownership, right-of-first refusals, and renewals. Responsibilities will include:

  • Reviewing, interpreting and drafting legal franchising documents

  • Assisting with updating franchise disclosure documents and franchise document precedents

Required Knowledge, Skills and Abilities:

Required Knowledge, Skills and Abilities

  • Minimum 3 years legal clerking or paralegal experience at a law firm or in-house legal department

  • Post-secondary degree or diploma in legal administration, law clerk or paralegal studies or related field from an accredited College or University

  • Experience in a franchising and/or real estate practice group

  • Proven ability to work independently with business partners

  • Strong organizational, administrative and communication skills

  • Attention to detail, takes pride in quality of documents

  • Comfortable working in a team environment, yet demonstrates ability to work independently

  • Ability to work in a flexible and dynamic environment; willingness to assist others and work on a variety of tasks

  • Able to handle sensitive matters with discretion and professionalism

  • Organized and demonstrates ability to work effectively in multi-tasking environment with high volume workload
